Terms of Service

These Terms of Service (“Terms”) govern your use of Smart Gout Care, operated by Ragondin Dev Inc. (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service (information only)
The Service provides general, informational guidance about food and gout risk. It is not medical advice, does not diagnose or treat any condition, and is not a substitute for advice from a healthcare professional.
2. Accounts & security
- You must provide accurate information and be at least 13 years old.
- You are responsible for your account activity. Use secure devices and keep your contact information up to date.
3. Subscriptions & billing
- Paid plans are purchased through the Apple App Store or Google Play (the “App Stores”). Pricing and taxes may vary by region.
- App Stores manage billing, renewals, and refunds under their policies. Manage or cancel your subscription in the relevant App Store settings.
- Some plans include a monthly limit of scans. If you reach the limit, additional scans require plan upgrade or the next monthly cycle.
4. User content
You may upload photos and related information. You retain ownership of your content. You grant us a limited license to process that content solely to operate and improve the Service. Do not upload unlawful, infringing, or harmful content.
5. Acceptable use
- No reverse engineering, scraping, or interfering with the Service.
- No attempting to bypass usage limits or access other users’ data.
- No uploading malicious code or violating applicable laws.
6. Privacy
Your use of the Service is subject to our Privacy Policy.
7. Intellectual property
The Service, including software, text, graphics, and trademarks, is owned by us or our licensors and protected by law. Except for the limited rights expressly granted, we reserve all rights.
8. Third-party services
The Service interfaces with third parties (e.g., cloud storage, App Stores). We are not responsible for third-party services; their terms govern your use of them.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US (EXCLUDING AMOUNTS PAID TO APP STORES) IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50, WHICHEVER IS GREATER.
11. Indemnification
You will defend, indemnify, and hold harmless Ragondin Dev Inc. and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm.
13. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflicts-of-law principles.
Arbitration & class-action waiver. Any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and we waive any right to participate in a class or representative action. You may opt out of arbitration by emailing chloe@smartgoutcare.com within 30 days of first accepting these Terms.
14. Changes to the Service or Terms
We may modify the Service or these Terms. If changes are material, we will provide reasonable notice (e.g., in-app). Continued use after changes become effective constitutes acceptance.
